Auf der Speisekarte der DPAG: Rechtliche oder ökonomische Marktzutrittsschranken?

Abstract

Im Zuge der durch europarechtliche Vorgaben erzwungenen Liberalisierung des deutschen Postmarktes wurde die Frage der vollständigen Öffnung des deutschen Marktes mit der Einführung eines branchenspezifischen Mindestlohnes verbunden. Der durch die bisherige Exklusivlizenz geschützte Monopolist DPAG hat diese Verknüpfung hingenommen, wenn nicht sogar vorangetrieben. Ökonomisch gesehen drängt sich der Eindruck auf, dass die DPAG die Marktzutrittsschranke „Exklusivlizenz“ gegen die des Mindestlohnes aufgegeben hat. Zunächst ist zu prüfen, ob ein solcher Mindestlohn den gleichen Marktschließungseffekt wie die Exklusivlizenz erreichen kann. Ein solches Verhalten ist ferner nicht ohne Risiken, da rechtlich die Tragfähigkeit des Mindestlohnes höchst umstritten ist und politisch unter einer anderen Zusammensetzung der Bundesregierung Mindestlöhne stark in Frage gestellt werden könnten. Möglicherweise ist die DPAG jedoch gar nicht auf eine Mindestlohnregelung „angewiesen“, wenn sie ihre unbestrittenen Größen- und Verbundvorteile zu einer ökonomischen Marktausschlussstrategie der Konkurrenten einsetzen würde. Ziel dieses Papiers ist es zu prüfen, welche industrieökonomischen Marktkonstellationen vorliegen müssten, damit eine ökonomische Marktausschlussstrategie denkbar wäre, und welche empirischen Belege hierfür sprechen.
