Abstract

[fre] Soumise aux dispositions du droit communautaire de la concurrence, l'entreprise multinationale peut, à tout moment, voir remise en cause sa politique tarifaire, commerciale ou sa stratégie de croissance externe dès lors qu'elle est convaincue d'occuper une « position dominante » sur un ou plusieurs marchés. La méthodologie utilisée par les autorités concurrentielles pour établir une telle situation rend les firmes du secteur agro-alimentaire particulièrement vulnérables aux dispositions de l'article 86 du Traité de Rome ou du règlement communautaire sur les opérations de concentration. [eng] Being subjected to the regulation of the E.C. policy, multinational companies can see their price, commercial and external growth policy questioned, as soon as they are found guilty of « dominant position » on one or several markets. The methodology adopted by the competition authorities to make such a diagnosis leads the companies of the agri-foodstuffs sector to be all the more vulnerable to the 86 article of the Treaty of Rome and to the regulations of the E.C. policy about concentration.
