Umstellung des Abfertigungsrechtes: Impuls oder Hemmnis auf dem österreichischen Arbeitsmarkt?

Abstract

Das gegenwärtige System der Abfertigung scheint den Anforderungen eines flexiblen Arbeitsmarktes nicht mehr zu entsprechen. Nur ein geringer Teil der beendeten Dienstverhältnisse erfüllt derzeit die Voraussetzungen für eine Abfertigungszahlung. Dem Parlament liegen Entschließungsanträge der ÖVP und der SPÖ zur Reform des Systems vor. Im Jahr 1999 wurde eine Expertengruppe eingesetzt, die beide Vorschläge analysierte. In ein beitragsorientiertes System werden kurze Arbeitsverhältnisse stärker eingebunden. Die Art der Auflösung eines Dienstverhältnisses soll künftig nicht mehr über die Anwartschaft auf eine Abfertigung entscheiden. Die Umstellung auf ein betriebsunabhängiges Beitragssystem stellt in beiden Modellen auf den Umbau des Abfertigungssystems in Richtung Pensionsvorsorge ab. Dennoch sind die Auswirkungen der zwei Modellvorschläge auf das Kündigungsverhalten der Arbeitgeber und Arbeitnehmer sowie auf die Mobilität recht unterschiedlich.
