Abstract

Jusqu'en 2008, les contrats à durée indéterminée se rompent soit à l'initiative de l'employeur par un licenciement, soit à l'initiative du salarié par une démission. En juin 2008, la loi française introduit une possibilité nouvelle, la rupture conventionnelle, séparation à l'amiable à l'issue de laquelle le salarié conserve ses droits à l'assurance chômage. En comparant l'évolution des établissements avant et après l'adoption des ruptures conventionnelles, nous montrons que ces nouvelles ruptures se substituent en partie à des licenciements pour motifs personnels, mais se déploient surtout dans des situations où l'on n'aurait observé aucune autre forme de fin de CDI avant la réforme. En conséquence, l'adoption des ruptures conventionnelles dans un établissement coïncide avec une hausse globale des ruptures de CDI, dont le taux augmente d'environ 18%. Partiellement compensé par de nouvelles embauches, ce surcroît de ruptures de CDI s'accompagne également d'une très légère érosion des effectifs. En définitive, la réforme de 2008 semble avoir contribué à rendre le marché du travail moins conflictuel, plus fluide, mais sans créer d'emplois.
