Order of occupancy in the settlement of pollution disputes

Abstract

In recent years, alternative dispute resolution (ADR) techniques have increasingly been applied to settle environmental disputes. The order of occupancy often becomes a point at issue in such settlement processes. This paper analyzes a micro-level dataset of environmental ADR to examine how the order of occupancy affects the settlement process. The results of duration analysis show that dispute settlement takes longer when the polluter starts emitting air pollutants or creating noise prior to the victims’ occupancy.
