Abstract

L'auteur analyse les conditions d'accès et d'usages des connaissances sur les ressources génétiques. Il considère alors les conséquences sur la gestion des ressources génétiques et le bien-être social dans un contexte de développement durable. Il analyse les conditions de transfert de technologies en termes de droits d'accès et de droits d'usages. L'absence d'une information sur la qualité des ressources biologiques et sur leur valeur, tant du côté de l'offre que de la demande, conduit à la construction d'une approche en terme de concurrence imparfaite. L'auteur examine alors comment un partage des avantages en faveur des pays en voie de développement (PVD) peut être réalisé par les instituts de recherche publique (le développement d'innovations en faveur des PVD), cette réalisation dépendant des conditions d'accès aux licences des brevets détenus par les entreprises privées.
