Tarifliche Mindestlöhne, Allgemeinverbindlichkeit und Entsenderichtlinie in Europa

Abstract

In Deutschland hat die Forderung nach Einführung eines allgemeinen gesetzlichen Mindestlohns an Bedeutung gewonnen. In diesem Beitrag werden zum einen die gesellschaftlichen und wirtschaftlichen Veränderungen aufgezeigt, die die Grundlage der Verbreitung dieser Forderung bilden, und zum anderen wird untersucht, warum einige europäische Länder einen gesetzlichen Mindestlohn nicht einführen und an der Tarifautonomie strikt festhalten wollen. Für die Debatte um Mindestlöhne in Deutschland lassen sich aus Sicht dieser Länder einige Erkenntnisse gewinnen. So wird dort die Einführung gesetzlicher Mindestlöhne u.a. wegen der Befürchtung abgelehnt, dass damit gleichzeitig die Tarifbindung abnehmen und die Tarifautonomie geschwächt werden könnten. Außerdem würde durch die Einführung eines allgemeinen gesetzlichen Mindestlohns die Möglichkeit der Anwendung der Entsenderichtlinie beträchtlich erweitert. Und möglicherweise würden niedrigere gesetzliche Mindestlöhne an die Stelle höherer tariflicher Mindestlöhne treten.
