Gibt es ein subjektives Recht auf öffentlichen Verkehr? Grundrechte statt Daseinsvorsorge

Abstract

Dieses Papier geht der Frage nach, ob eine staatliche Rechtspflicht besteht, ein bestimmtes Niveau öffentlicher (Nah-)verkehrsversorgung zu gewährleisten - abgesichert durch ein einklagbares subjektives Recht. In den einschlägigen Gesetzesmaterien des Bundes und der Länder wird man auf der Suche nach einem subjektiven Recht nicht fündig. Es kann auch nicht aus einem tradierten Standard von Daseinsvorsorge, sondern letztlich nur aus den Grundrechten des Grundgesetzes gewonnen werden. Ein solches allgemeines Recht auf öffentlichen Verkehr ist rechtlich existent, jedoch nur unter sehr engen Voraussetzungen und nur für eine minimale Versorgung zu haben. Zudem könnten die Gerichte im konkreten Falle nur dahingehend abhelfen, den Gesetzgeber auf Maßnahmen zu verpflichten, da die konkrete Ausführung von Verkehrsleistungen zunehmend privaten Anbietern überlassen wird. Einer punktuellen Verschlechterung des Verkehrsniveaus kann das subjektive Recht jedenfalls nicht entgegengehalten werden. Für die über das Minimalrecht hinausgehende und daher nicht einklagbare staatliche Verpflichtung steht den entscheidenden Trägern - also den Gesetzgebern - ein Einschätzungsspielraum zu.
