Abstract

Im Working Paper werden die Einhaltung (Compliance) und Durchsetzung (Enforcement) von gesetzlichen geregelten Mindestarbeitsbedingungen der Beschäftigten am Beispiel des Bauhauptgewerbes, der Fleischwirtschaft sowie des Gastgewerbes untersucht. Der Fokus wird auf Lohnansprüche von abhängig Beschäftigten gerichtet, die sich aus dem Arbeitnehmer-Entsendegesetz bzw. dem Mindestlohngesetz ergeben. Dabei werden Durchsetzungs- und Kontrollstrategien unterschiedlicher Akteure und Institutionen analysiert und hinsichtlich ihrer Wirksamkeit bewertet. Darüber hinaus werden Ansatzpunkte aufgezeigt, wie Mindestlohnansprüche effektiver durchgesetzt werden könnten.
