¿Cuál Es El Costo De La Contaminación Ambiental Minerasobre Los Recursos Hídricos En El Perú?: Comentarios

Abstract

Este trabajo realiza comentarios y observaciones a la investigación de Herrera y Millones (2011).1 En primer lugar, se analiza este estudio desde la perspectiva metodológica considerando los siguientes puntos: a) el cálculo del valor del daño ambiental minero utilizando precios sombra, b) el tratamiento de la información y las posibles limitaciones de los resultados, y c) el análisis de algunos detalles técnicos que se deben tener en cuenta al realizar estimaciones econométricas de segunda etapa utilizando los resultados del análisis de fronteras productivas de eficiencia. En segundo lugar, se formulan comentarios sobre la teoría económica de la ejecución pública de las leyes, marco de análisis del sistema sancionador del Organismo Supervisor de la Inversión en Energía y Minería del Perú (OSINERGMIN). Por último, se realizan precisiones sobre el marco normativo de sanciones que aplica OSINERGMIN, el cual ha introducido criterios económicos en diferentes sectores bajo su jurisdicción, incluyendo el sector minero. Los comentarios señalan que algunos elementos presentados en el estudio deben tomarse con cautela y que las conclusiones del trabajo no han tomado en cuenta que dentro de las funciones asignadas a OSINERGMIN no está el recaudar fondos para la remediación de los daños ambientales mineros. Bajo la legislación actual, la remediación corresponde a las empresas que ocasionaron daños ambientales. Además, es importante destacar que OSINERGMIN aplicó originalmente el esquema de sanciones administrativo transferido por el Ministerio de Energía y Minas del Perú (MINEM) en el año 2007, pero que luego modificó la escala de sanciones heredada para hacerla más consistente con un régimen sancionador óptimo.
