Reformüberlegungen und Marktasymmetrie: Die Potenziale einer Abfindungslösung

Abstract

Die Beschäftigung in Deutschland ist in den letzten Jahren stark angestiegen, zu einem Teil auch in neuartigen und flexiblen Arbeitsverhältnissen, zu denen etwa die Zeitarbeit und die befristete Beschäftigung zählen. Damit hat sich eine Zweiteilung des Arbeitsmarktes in Arbeitsverhältnisse mit hoher Bestandssicherheit und flexiblere, weniger stabile Jobs ergeben. Dies kann zum Teil mit der unterschiedlichen Regulierung von Normalarbeitsverhältnissen und "atypischen" Arbeitsverhältnissen erklärt werden. Dieser IZA Standpunkt diskutiert die Möglichkeiten einer systematischen Reform der arbeitsrechtlichen Vorschriften im Bereich Kündigungsschutz und Befristung, insbesondere die Ersetzung des starken Bestandsschutzes von unbefristeten Verträgen in Deutschland durch ein Abfindungsmodell.
