Reforma Laboral 2010: Una primera evaluación y propuestas de mejora

Abstract

El objetivo de este artículo es doble. En primer lugar, se trata de realizar una primera evaluación de la última reforma laboral aprobada. En segundo lugar, se presentan propuestas de mejora que podrían desarrollarse a partir de enero de 2012, fecha prevista para la implantación en España del denominado “modelo austriaco”. En concreto, llegamos a la conclusión de que esta reforma, por continuista, tampoco conseguirá reducir sustancialmente la excesiva tasa de rotación laboral originada por nuestra legislación laboral. Después de 25 años y varios intentos fallidos, convendría aprovechar la segunda fase de esta reforma para poner en marcha un nuevo sistema contractual que combine un único contrato (con indemnizaciones crecientes con la antigüedad) para todas las nuevas relaciones laborales y un fondo de capitalización a la austriaca. Este nuevo marco resultaría más eficaz que el resultante de esta primera fase de la reforma para hacer frente a la persistente segmentación de nuestro mercado de trabajo, y, por otra parte, aunque no sea el óptimo, si que debería ser factible desde la perspectiva de la política económica.
