Productivity in civil justice in Portugal: A crucial issue in a congested system

Abstract

This article focuses on the determinants of productivity in civil justice in Portugal using panel data covering the period from 1993 to 2013, from a strictly quantitative perspective. The performance indicators and the relationship between demand and resource distribution in the territory suggest that there is room for improving the allocation of resources. Such evidence is confirmed by a positive response of productivity to incoming cases per judge, taking into account the casemix. Moreover, productivity is positively impacted by both the number of judicial staff per judge and the proportion of cases resolved in judgeships that deal mainly with civil cases.
