Der Entwurf des Berufsausbildungssicherungsgesetzes: Wirkungen und Nebenwirkungen

Abstract

Nach verschiedenen Berechnungen werden im Jahr 2004 noch mehr Ausbildungsplätze fehlen, als dies im Jahr 2003 der Fall war. Den Forderungen nach einer Schließung der Ausbildungslücke folgend, sollten so viele Ausbildungsplätze bereitgestellt werden, wie es Bewerber gibt. Das "Berufsausbildungssicherungsgesetz" sieht eine jährliche Prüfung der Ausbildungslücke zum 30. September durch die Regierung vor. Wenn die Zahl der bundesweit gemeldeten Ausbildungsplätze, die noch unbesetzt sind, nicht mindestens 15% über der Zahl der noch nicht vermittelten Bewerber liegt, dann wird - so der Gesetzesentwurf der Bundesregierung - jeder Arbeitgeber, der im Vorjahr nicht die "notwendige Ausbildungsquote" von 7% seiner sozialversicherungspflichtig Beschäftigten erreicht hat, mit einer "Berufsausbildungssicherungsabgabe" belegt. Ausgenommen sind kleine Arbeitgeber mit bis zu zehn sozialversicherungspflichtig Beschäftigten und größere Arbeitgeber, wenn die Abgabe eine "unzumutbare Härte" darstellen würde. Statt das Engagement der Wirtschaft anzuerkennen und zu fördern, versucht man also mit der Drohung einer Ausbildungsplatzabgabe die Wirtschaft zu zwingen, die nötigen Ausbildungsplätze zu schaffen. Der Beitrag diskutiert, wie diese Maßnahme zu beurteilen ist.
