Abstract

The aim of this article is to expand the idea of mandatory voting concept in case of such regulators in different jurisdictions may have the intention to apply in listed companies. It further highlights the supporting and opposing views and several arguments based on existing acts and regulations. Conventional current banking and financial practises whether they are regulated or not show that some major difficulties may arise. Then, suggested framework driven from the essence of Islamic finance may solve such issues and make this concept operative. Otherwise, with no change or improper changes, this concept might be used against its purpose and would be misused by market players إن الهدف من هذه الورقة هو توسيع فكرة مبدأ التصويت الإلزامي، في حالة رغبة المنظمين في عدة بلدان، تطبيق المبدأ على الشركات المساهمة. يلقي البحث الضوء على الآراء الداعمة والمعارضة وحجج كل فريق منهما والمرتكزة أساسًا على الأنظمة والقوانين الحالية. إن الممارسات المصرفية والمالية التقليدية الحالية، بغض النظر عما إذا كانت منظمة أم لا، تظهر صعوبات جوهرية تنشأ من تطبيق المبدأ ومع ذلك فإن الهدف من بحثنا هو إثارة النقاش والتحليل حول الموضوع. بعد ذلك، يقدم الباحث إطارًا مقترحًا مرتكزا على مبادئ التمويل الإسلامي يقوم بحل تلك الإشكاليات ويجعل المبدأ فعالاً عند التطبيق. بدون تغيير أو تغييرات صحيحة، لكن يحذر الباحث من إمكانية استغلال المبدأ على خلاف الغرض الذي أقر من أجله ولربما يتم إساءة استخدامه من قبل صناع السوق.
