Abstract

PRESENTACIÓN El derecho de aguas es una rama del ordenamiento jurídico cuyo conocimiento se hace urgente en la medida que los conflictos por el recurso hídrico se incrementan y las dificultades en la gobernanza del agua se hacen más evidentes. Es por ello que desde la academia sigue siendo relevante impulsar las investigaciones y promover la socialización del conocimiento que se genera desde el ámbito universitario. Así las cosas, el tomo VII de la colección Derecho de aguas pretende dar a conocer los resultados de la línea de investigación Derecho Ambiental General y su proyecto Derecho de Aguas, el cual ha contado en esta ocasión con la participación de diferentes expertos nacionales y extranjeros, quienes han analizado múltiples asuntos de actualidad en la materia. La obra ha sido dividida en dos partes. La primera de ellas está dedicada al derecho de aguas en Colombia, y la segunda, al estudio del derecho y la gestión de aguas en el escenario internacional. Da inicio a la primera parte del libro el artículo del profesor investigador Álvaro Hernando Cardona González, quien analiza las competencias de las autoridades ambientales en materia de exploración y aprovechamiento de las aguas subterráneas, partiendo de su naturaleza de bienes de dominio público y haciendo llamados por una intervención reglamentaria que permita una mayor tutela del recurso hídrico subterráneo. En esta ocasión dos artículos analizan el derecho humano al agua desde diferentes perspectivas. Andrea Bernal y Angélica Rangel Amado, desde las necesidades de ajuste político y normativo necesarios para el cumplimiento del sexto Objetivo de Desarrollo Sostenible (ODS), y Roberth Lesmes Orjuela, desde una perspectiva histórica.Lesmes Orjuela examina la regulación jurídica del agua en Colombia y la forma como, a través de diversos instrumentos normativos, se ha procurado la protección. Por su parte, Constanza Bejarano Ramos estudió la necesaria relación entre el agua y la producción de alimentos a través del análisis regulatorio que se ha adoptado en Colombia para procurar una gestión integrada de recursos hídricos. El investigador Eduardo del Valle Mora examinó el marco jurídico aplicable a la construcción de pequeñas centrales hidroeléctricas en Colombia. Su estudio parte de la identificación de instrumentos de comando y control aplicables, para luego centrarse en las disposiciones en materia de concesiones
