Abstract

El Derecho del medio ambiente es una rama del derecho en permanente evolución cuyos cambios se ven impulsados por múltiples factores tales como el avance científico, la mayor concientización sobre la relación de pertenencia y dependencia del hombre con la naturaleza, los graves daños ambientales, las fuerzas sociales que exigen avanzar hacia una protección ambiental más efectiva, la certeza sobre los riesgos que genera el uso de ciertos elementos o el desarrollo de algunos proyectos, el afán de mantener la integridad humana y el reconocimiento de la ineludible tarea de seguir avanzando en la protección del entorno natural. Este cambio permanente exige de la academia un análisis no solo de los nuevos contenidos normativos sino, además, de la reacción de los tribunales y de la sociedad ante las nuevas realidades jurídicas, tarea que fue asumida desde I999 ininterrumpidamente por el Grupo de Investigación en Derecho del Medio Ambiente de la Universidad Externado de Colombia, y que se ve reflejada en la colección "Lecturas sobre Derecho del Medio Ambiente" en la cual se presenta una variedad de artículos resultado de las investigaciones realizadas por los miembros del grupo y por invitados que han querido participar de esta obra colectiva. El tomo XVI de esta colección presenta novedosas perspectivas del estudio jurídico ambiental. La obra se inicia con el artículo del profesor Álvaro Hernando Cardona "Una Encíclica ecológica: Laudato Si"\', quien a partir de la descripción del texto religioso analiza la forma como su contenido podría verse reflejado en la normatividad colombiana y en algunos escenarios e instrumentos jurídicos de escala internacional.
