Abstract

¿Cómo y en qué momento surge el delito de corrupción privada? ¿Por qué lo que antes aparecía como una práctica de libre competencia ahora constituye un potencial y peligroso desestabilizador social? El sistema financiero, envuelto regularmente en escándalos de corrupción, y generador de importantes crisis económicas, plantea inmensos retos en materia de regulación, supervisión y sanción. Ante ese panorama el Estado debe responder con soluciones que incluyan Id implementación de herramientas de ética empresarial y de autorregulación en el interior de las instituciones sociales en lo que se ha denominado la sociedad del riesgo. Y es que el soborno corporativo se ha convertido en una institución que encubre los conflictos de intereses y trae consigo prácticas de delación e incentivos que permiten la exoneración de la culpa, amenazando con ello el desarrollo de la libre competencia. Estas materias, además de un detallado análisis del fraude en Interbolsa y el Fondo Premium, componen este tercer tomo de la serie en el que los investigadores aportan sus conocimientos con rigor y detalle en busca de soluciones que blinden a las instituciones ante las prácticas corruptas.
