Le interazioni fiduciarie nel rapporto di lavoro. Dalle origini ai cambiamenti in atto

Abstract

Il presente contributo si prefigge lo scopo di rilevare come l?elemento fiduciario, ricollegabile al pi? ampio concetto di fides, permea, ancora oggi, l?intero rapporto di lavoro sotto una duplice angolazione. Nella fase iniziale del rapporto stesso, la fiducia viene in rilievo sotto il profilo soggettivo cos? si desume dagli artt. 2094 e 2086 c.c. e valutabile secondo i generali criteri di buona fede e correttezza. Invece, nella fase estintiva, l?elemento fiduciario si oggettivizza costituendo la ragione giu-stificativa dell?adempimento della prestazione lavorativa da parte del lavoratore.
