Sektorspezifische Regulierung: Transitorisch oder ad infinitum?Eine internationale Bestandsaufnahme von Regulierungsinstitutionen

Abstract

Das ifo Institut hat bereits zu Beginn des europäischen Liberalisierungsprozesses die Organisation von Regulierungsbehörden untersucht. Der vorliegende Beitrag knüpft mit einem internationalen Vergleich der Regulierungsinstitutionen an diese Arbeiten an. Am Beispiel der Telekommunikationsindustrie werden die Auswirkungen veränderter Markt- und Wettbewerbsbedingungen auf das institutionelle Gefüge dieser Behörden analysiert. Es stellt sich vor allem die Frage, ob die hohe Wettbewerbs- und Innovationsdynamik im Telekommunikationssektor mit institutionellen Anpassungen der nationalen Regulierungsbehörden einhergeht, die letztendlich in die Marktaufsicht durch Institutionen des allgemeinen Wettbewerbsrechts führen sollten. Es zeigte sich, dass in keinem der elf in die Untersuchung einbezogenen Länder - trotz des starken Anstiegs der Wettbewerbsintensität auf den Telekommunikationsmärkten - die Regulierung auch im zehnten Jahr der vollständigen Liberalisierung der TK-Märkte in das allgemeine Wettbewerbsrecht überführt wurde.
