Fragmentation des frontières de la firme et dilution des responsabilités juridiques : l'éclatement de la relation d'emploi dans la firme-réseau multinationale

Abstract

The emergence and development of global network-firms have strongly contributed to reconsidering the legal-economic regulatory models of industrial relationships and modern capitalism. Using diverse relational governance mechanisms, the network-firm is based both on capital disintegration and on the decomposition of the collective legal responsibilities, notably in terms of regulation of employment communities. What are the economic foundations that underlie this movement towards the bypass of legal obligations ? In a law and economics perspective, this paper aims at analyzing the positive and normative implications that result from this movement towards the dilution of responsibilities. This research question will be dealt with from the salient question of the boundaries of the global network-firm.
