Schattenregulierung in der Telekommunikationswirtschaft

Abstract

Thematisiert wird die Rolle potenzieller bzw. angedrohter Regulierungsmaßnahmen bzw. von informeller "Schattenregulierung" in der Telekommunikationswirtschaft. Analytischer Rahmen ist dabei die Existenz multinationaler Unternehmen in offenen Volkswirtschaften, was als der Realität angemessener Ansatz zu sehen ist und die wohlfahrtsökonomische Analyse der Regulierung beeinflusst. Dabei stehen mit Blick auf die Rolle von Schattenregulierung die Wirkungen auf Preise, Investitionen und Innovationen sowie Börsenwert im Vordergrund der Betrachtung. In den technologiedynamischen Telekommunikationsmärkten mit ihrem hohen Potenzial an Prozess- und Produktinnovationen im Infrastruktur-bzw. im digitalen Dienstebereich sind Schattenregulierungen ausökonomischer bzw. theoretischer Sicht kritisch zu sehen. Dies ergibt sich insbesondere dann, wenn Schattenregulierungen auf einen Unsicherheitsaufschlag für führende Investoren bzw. Innovatoren hinauslaufen, so dass sich erhöhte Preise und gesamtwirtschaftlich reduzierte Investitionen und Produktionsmengen ergeben. Daher sind diskretionäre Regulierungsspielräume der Wettbewerbsaufsichtsbehörden sinnvoll zu beschränken. Für eine rationale Regulierung der Telekommunikation in der EU ist auf supranationaler und nationaler Ebene von Seiten der Wirtschaftspolitik Sorge dafür zu tragen, dass nicht durch Expansion von Schattenregulierungen eine ordnungspolitisch problematische und investitions- bzw. innovationsseitig schädliche Fehlentwicklung stattfindet; tatsächlich können unter bestimmten Bedingungen Access Holidays und Sunset-Klauseln sinnvolle Instrumente sein, um mehr infrastrukturbasierten Wettbewerb herbeizuführen und eine schrittweise Deregulierung voranzubringen.
