Solución de controversias en los TLC. Aportes del Derecho de la OMC

Abstract

La inserción de los Estados en el comercio internacional se hace particularmente notoria con la proliferación de acuerdos internacionales cuya morfología varía desde aquellos que regulan las zonas de libre comercio, de los cuales se tiene noticia diariamente, hasta los acuerdos negociados multilateralmente bajo el auspicio de la Organización Mundial del Comercio (OMC). Independiente de la forma como asuman estos instrumentos, todos comparten un propósito: dotar de previsibilidad y seguridad jurídica los intercambios económicos. De ahí que los mecanismos de solución de controversias sean, sin duda, uno de los elementos centrales de todo acuerdo comercial, en tanto no solo representa un instrumento procesal para resolver las diferencias que se dan en la aplicación e interpretación de las obligaciones adquiridas por los Estados en el instrumento internacional, sino que también refuerzan el cumplimiento de las mismas y tratan de evitar que una controversia comercial se “politice”. Esto explica la necesidad de un mecanismo de solución de controversias en los tratados de libre comercio (TLC) celebrados por Estados Unidos y la Unión Europea con países latinoamericanos. Es en tal contexto que el interés de este libro sea el de realizar un estudio comparativo y del grado de aproximación de los mecanismos de solución de controversias en los TLC al sistema de solución de diferencias de la OMC en sus diferentes etapas, actuaciones procesales y principios.
