Entre la propiedad agraria y la ambiental: El debate respecto a los derechos de propiedad de la tierra

Abstract

Este articulo aborda como la progresiva integracion de las consideraciones ambientales en las politicas agrarias conlleva la reconfiguracion de los derechos de propiedad sobre la tierra. En este sentido, el articulo plantea como los propietarios de la tierra han encontrado en dicho proceso una nueva fuente de legitimidad para la defensa del statu quo de la propiedad. Un recorrido por algunas de las politicas agarias y ambientales de mas relevancia en la Union Europea (los programas agroambientales, el pago unico de la PAC, o la evolucion de la Red Natura 2000) nor permite profundizar en los argumentos que apuntan en dicha direccion. De igual manera, algunos casos donde esta creciente integracion ambiental se ha producido de forma mas territorializada y participativa, muestran tambien el peso de los actores agrarios y la propiedad de la tierra en el resultado final. El articulo concluye defendiendo la necesidad de considerar los aspectos de justicia distributiva y de procedimiento, especialmente en el nuevo contexto agro-alimentario global. This article tackles how the gradual integration of environmental concerns into agricultural policies leads to reshape land property rights. In this regard, the paper argues that landholders have found in that process a source legitimacy to defend the status quo of private property. An overview of relevant EU policies (agri-environmental schemes, Single Farm Payment and Natura 2000 Network) allows to deepen into the arguments pointing out in that firection. In the same sense, other examples of a more territorial and participatory agrienvironmental integration also show the weight of farming community and property holders' interests in the final outcome. The paper concludes defending the need to integrate distributive and procedural justice, particularly in the new global agri-food context.
