Marktzutrittsbarrieren in den USA und Kanada: Der Markt für meerestechnische Güter und Dienstleistungen

Abstract

Die derzeit angespannten handelspolitischen Beziehungen zwischen Europa und den Vereinigten Staaten werfen die Frage nach dem tatsächlichen Protektionsgrad auf, mit dem international tätige deutsche Unternehmen in Nordamerika konfrontiert werden. Würde in Nordamerika eine Abschottungspolitik verfolgt, so träfe sie am ehesten deutsche Branchen, die – wie die rohstoffbezogene meerestechnische Industrie – besonders intensiv auf Auslandsmärkte angewiesen sind. Vor diesem Hintergrund hat der Bundesminister für Wirtschaft dem Institut für Weltwirtschaft einen Forschungsauftrag zum Thema "Hemmnisse in den USA und Kanada für den Zugang ausländischer Unternehmen zu Offshore-Aktivitäten und die Lieferung meerestechnischer Anlagen und Geräte" erteilt. Ziel dieses Forschungsprojektes war es, zu untersuchen, ob in den Vereinigten Staaten und Kanada Hemmnisse für den Zugang ausländischer Unternehmen zum Markt für Meerestechnik bestehen, derartige Hemmnisse gegebenenfalls darzustellen und ihre potentiellen Auswirkungen auf die deutsche Meereswirtschaft zu analysieren. In dieser Studie, die aus dem Forschungsauftrag hervorgegangen ist, wird zunächst dargelegt, welches Recht in den relevanten Meeresgebieten derzeit gilt. Ein Überblick über die Ressourcenausstattung und deren bisherige Nutzung sowie eine eingehende Analyse der nordamerikanischen Märkte für meerestechnische Erzeugnisse und Dienstleistungen schließt sich an. Danach werden die Rahmenbedingungen für ausländische Unternehmen herausgearbeitet und mit den für Inländer geltenden Bedingungen verglichen, um festzustellen, ob und inwieweit deutsche Unternehmen benachteiligt werden. Die so identifizierten Diskriminierungen werden dann aus ökonomischer und rechtlicher Sicht bewertet. Abschließend werden die wichtigsten Ergebnisse zusammengefaßt und mit einigen wirtschafts- und rechtspolitischen Empfehlungen verknüpft.
