Der Staat als ,Guter Auftraggeber': Herausforderungen und Strategien in der sozialverantwortlichen Vergabepraxis

Abstract

An öffentliche Auftraggeber richtet sich zunehmend die Erwartung, gute Arbeitsbedingungen für die Beschäftigten beauftragter Firmen zu gewährleisten. Zugleich müssen sie ein umfangreiches Korsett wettbewerbsrechtlicher Regelungen beachten. Zudem steigt der Anspruch an die Qualität der eingekauften Dienstleistungen. Aus diesen widersprüchlichen Anforderungen erwachsen in der Vergabepraxis zahlreiche Konflikte und Herausforderungen, mit denen Kommunen unterschiedlich umgehen. In den untersuchten Kommunen steht im Ergebnis von Lernprozessen zunehmend die Qualität der Dienstleistung im Vordergrund; die Arbeitsqualität wird bestenfalls als funktionale Voraussetzung dafür mitberücksichtigt. Insgesamt bedarf es für eine sozialverantwortliche Vergabepraxis weiterer Reformen und infrastruktureller Unterstützung
