Wettbewerbsprobleme im Lebensmitteleinzelhandel

Abstract

Der vorliegende Beitrag befasst sich mit aktuellen Wettbewerbsproblemen im deutschen Lebensmitteleinzelhandel. Im Mittelpunkt der Analyse stehen der zunehmende Konzentrationsprozess und seine Determinanten. Darauf aufbauend diskutieren wir Aspekte der Marktabgrenzung insbesondere im Hinblick auf Discounter sowie die aus dem Konzentrationsprozess unter Umständen resultierende Nachfragemacht des Handels. Die Darstellung zeigt, dass Nachfragemacht von Händlern nicht pauschal bewertet werden kann, sondern ein dynamisches Phänomen darstellt, welches im Einzelfall betrachtet werden muss. Darüber hinaus ist bislang keineswegs klar, ob Nachfragemacht tatsächlich negative Effekte auf Wettbewerb oder Verbraucher hat. Des Weiteren werden die jüngsten Empfehlungen der Monopolkommission in Bezug auf die wettbewerbsrechtliche Behandlung von Nachfragemacht ausführlich gewürdigt. Hier ist insbesondere die ablehnende Haltung der Monopolkommission bezüglich des Verbots von Verkäufen unter Einstandspreisen sowie die Behandlung vertikaler Bindungen zu nennen.
