Efficienza Giudiziaria e Mercato Forense

Abstract

L'efficienza giudiziaria è uno dei principali obiettivi di ogni stato democratico. Un sistema giudiziario efficiente è cruciale sia dal punto di vista economico sia dal punto di vista sociale poiché costituisce uno dei pilastri fondamentali delle società moderne. Lo studio qui proposto si pone l'obiettivo di stimare l'efficienza del sistema giudiziario italiano di primo grado e le determinanti dell'inefficienza. Nello specifico, si testa l'ipotesi che il numero di professionisti sul mercato dei servizi legali (professione forense) sia in grado di condizionare positivamente l'offerta di giustizia e quindi le performance degli uffici giudiziari. Pertanto, si studierà la relazione tra il numero di avvocati e lo score di efficienza di questi uffici, ipotizzando che la competitività sul mercato forense sia in grado di migliorare le performance dei Tribunali Ordinari. La conferma di quanto ipotizzato potrebbe dare un ulteriore impulso al processo di riforma della professione forense, già avviato nella XVI° legislatura.
