[Institutional Reform and Reform of Regulation as the Presumption for the Utilities’ Public Companies Transformation]

Abstract

English. The paper considers the problems of the regulation of public utilities, as the specific branches, they at the same time to economic and social development area belong. It was showed the specificities and characteristics of these branches, and the institutional frame for the making these utilities, where an important factor the existence of many acts its use makes difficult. Among the institutional solutions particularly important is the fact that these utilities only through public state companies can make be, that inflexible and ineffective is, especially because its heterogeneous character. Public state utilities companies weighed down, even more than other companies, with the same problems as the other companies, especially with great number of (fictive) employees, unnecessary secondary (commercial) branches, they in institutional frame of public state company ineffective and not understandable are, etc. On the other side, the regulation of these branches at many years comes to the price control, with strong social direction. This one, combined with predominantly budgetary financing and development, makes the strong the elements of its ineffectiveness and non rationality of these branches and complex its transformation. Results of such regulatory solutions appear as depreciation of its prices, but its growth during the few last years, without reforms of institutional frame and regulatory solutions, can’t make important progress in this whole area. Serbian. У раду се разматрају проблеми регулације комуналних делатности, као специфичних делатности које истовремено припадају и подручју економског и подручју социјалног развоја. Указано је на специфичности и карактеристике ових делатности као и на институционални оквир њиховог обављања, где се као значајан елемент истиче преплитање већег броја закона и других аката чије се одредбе често преплићу и знатно отежавају сналажење и применљивост. У оквиру институционалних решења посебно је значајно што се комуналне делатности обављају искључиво преко јавних предузећа, што је нефлексибилно и неефикасно решење, посебно имајући у виду разнородни карактер ових делатности. Сама јавна комунална предузећа оптерећена су, чак и у већој мери, истим проблемима с којима су се сусретала и друга предузећа у нашој привреди, посебно великим бројем (фиктивно) запослених, непотребним постојањем споредних (комерцијалних) делатности чије је обављање у институционалном аранжману јавних предузећа неефикасно и неразумљиво, итд. С друге стране, и сама регулација ових делатности већ годинама се своди на разне облике контроле цена, с јаким социјалним усмерењем, што уз наглашени буџетски облик њиховог финансирања и развоја појачава елементе неефикасности и нерационалности ове области и чини сложеним њену трансформацију. Резултати оваквих регулаторних решења изражени су депресираношћу цена комуналних услуга, али само њихово повећавање током претходних неколико година, без реформе и институционалног оквира и регулаторних решења, не може да резултира и значајнијим помаком у целокупној овој области.
