Abstract

Резюме: Предмет на научния анализ е актуалната правна уредба на административноказателната отговорност за маловажно административно нарушение на трудовото законодателство (чл. 415в от Кодекса на труда) след последните промени в Кодекса на труда от края на м. януари 2012 г. Направено е сравнение между действащата и отменената правна уредба на тази материя. В изследването е направен коментар на много съдебни решения, като е обърнато специално внимание и на тълкувателното решение на Върховния административен съд, както по отношение на неговите мотиви, така и на значението му след последното изменение на чл. 415в от Кодекса на труда.
