Abstract

Резюме: В студията се дава отговор на поставения тълкувателен въпрос по тълкувателно дело № 2 от 2021 г. на Общото събрание на съдиите от колегиите на Върховния административен съд. Въз основа на позитивно-правни и логически аргументи се обосновава, че разпоредбата на чл. 1, ал. 1 от Закона за отговорността на държавата и общините за вреди при претенция за обезщетение за неимуществени вреди, причинени от отменена като незаконосъобразна заповед за прекратяване на служебно правоотношение, когато специален закон предвижда право на обезщетение в размер на получаваните възнаграждения, е неприложима.
