Un ordre constitutionnel libéral est-il le seul fondement possible d'un droit mondial de l'investissement?

Abstract

Nous retiendrons successivement trois perspectives pour rendre compte de l'émergence d'un droit mondial de l'investissement : - une perspective historique qui nous permettra de mettre en évidence le triomphe du constitutionnalisme libéral, - une perspective analytique qui nous permettra d'en montrer les failles et les insuffisances, auxquelles actuellement seul un droit mondial de la concurrence peut suppléer, - une perspective pragmatique qui permettra de mettre en évidence comment les pays en développement ont pu sauvegarder par la négociation une flexibilité suffisante pour établir un équilibre entre les impératifs du développement durable et ceux de la libéralisation des investissements étrangers directs.
