Les investissements directs dans l'O.M.C

Abstract

[fre] Cet article présente d'abord les différentes dispositions des accords de l'О.М.С. susceptibles d'affecter les investissements directs à l'étranger et rappelle l'importance de ce point de vue des accords sur les services et la propriété intellectuelle. La question de l'évaluation des effets de ces dif- férentes dispositions et en particulier de l'accord TRIMs est abordée dans un deuxième temps. La discussion fait ressortir les difficultés liées à une telle évaluation. Quelques éléments de réflexion en rapport avec le débat concernant la réglementation multilatérale des investissements directs viennent compléter la discussion. [eng] This paper first looks at those rules in the W.T.O. agreements which are relevant to foreign direct investments and highlights the importance of the Agreements on trade in services and on intellectual property in this perspective. The discussion then focuses on the TRIMs Agreement's impact on F.D.I. The difficulties associated with an assessment of this impact are highlighted. The paper ends with a presentation of the main arguments in the debate about the need for a multilateral regulation of F.D.I.
