Ökonomik des Arbeitskampfrechts

Abstract

Zur Ausübung der Koalitionsfreiheit gehören auch das Recht auf Streik und das Recht auf Aussperrung. Da eine gesetzliche Regelung dieser Rechte fehlt, hat die Rechtsprechung einen institutionellen Rahmen für das Arbeitskampfrecht entwickelt. Wesentliche Elemente dieses Rechtsrahmens wie die Verhältnismäßigkeit von Arbeitskämpfen, das Ultima-Ratio-Prinzip oder die Rechtsprechung zu bestimmten Streikformen wie dem Warn- oder dem Unterstützungsstreik werden einer ökonomischen Analyse unterzogen. Ausgangspunkt ist die Überlegung, dass eine funktionsfähige Tarifautonomie gleich starke Verhandlungspartner voraussetzt. Dazu bedarf es eines arbeitskampfrechtlichen Ordnungsrahmens, der für ausgewogene Machtverhältnisse sorgt. Darüber hinaus sollte dieser Rahmen negativen Drittwirkungen Schranken setzen. Die Analyse zeigt, dass vor allem bei der Ausgestaltung der Verhältnismäßigkeit, der Zulässigkeit von Unterstützungsstreiks und beim Auftreten von Gewerkschaftskonkurrenz mit Tarifpluralität zusätzlicher rechtlicher Handlungsbedarf besteht.
