Sicherung sozial-ökologischer Standards durch Partizipation: Das Beispiel nichtstaatlicher Akteure im internationalen Recht

Abstract

Die vorliegende Untersuchung fragt nach Chancen und Grenzen von Partizipation in all ihren Erscheinungsformen (Gesetzgebung, Verwaltung, Gerichte, Konsumentenhandeln, diverse informelle Partizipationsformen). Die Studie zielt neben einer allgemeinen Klärung jener Fragestellung insbesondere auf eine Analyse der verschiedenen eben genannten Partizipationsformen auf internationaler Ebene, da dieser Bereich (auch) in den Debatten seit Stuttgart 21 weitgehend unterrepräsentiert ist. Dabei kommen die Chancen von Partizipation in den Blick, aber auch vielfältige Probleme: etwa demokratische Legitimation, geringe Motivation zur Partizipation, Aporie von Offenheit und strategisch zwecks bestimmter Ziele gewünschter Partizipation, begrenzte Macht der Partizipierenden
