Rechtsprobleme der tariflichen Unterbietungskonkurrenz

Abstract

Das Thema der tariflichen Unterbietungskonkurrenz ist aktueller denn je, werden doch zunehmend Tarifverträge von wirtschaftsfriedlichen, zum Teil gar vom Arbeitgeber abhängigen Organisationen abgeschlossen. Diese Tarifverträge entsprechen erkennbar nicht dem Interesse der Beschäftigten, da sie entweder bereits bestehende Tarifverträge von (DGB-) Gewerkschaften eklatant unterbieten oder von tarifdispositivem Gesetzesrecht nach unten abweichen, ohne entsprechende kompensatorische Leistungen vorzusehen. Der vorliegende Band beleuchtet verschiedene Facetten der Thematik. Nach einer tarifrechtlichen Einführung (Wendeling-Schröder), werden einerseits die von der Rechtsprechung aufgestellten Kriterien der Gewerkschafts- und insbesondere der Tariffähigkeit analysiert, auch unter Berücksichtigung der von den Sachverständigenausschüssen der Internationalen Arbeitsorganisation (ILO) entwickelten Kriterien (Zimmer). Untersucht werden ferner die Handlungsmöglichkeiten von Gewerkschaften beim Auftreten "gelber Organisationen" im Betrieb (Däubler). Auch dieser Beitrag bezieht die "Spruchpraxis" der ILO mit ein. Berücksichtigt wird ferner die aktuelle Rechtsprechung des BAG. So geht der Beitrag von Zimmer explizit auf die BAG-Entscheidung vom 05.10.2010 zur Tariffähigkeit der GKH ein, während Brors die Auswirkungen der CGZP-Entscheidung vom 14.12.2010 analysiert. Abgerundet wird der Band durch einen Beitrag zu transnationaler tariflicher Unterbietungskonkurrenz, in dem Rödl herausarbeitet, welche technischen Ansatzpunkte das deutsche Arbeitsrecht den Strategien transnationaler Unterbietungskonkurrenz eröffnet - und welche rechtlichen Gegenstrategien ergriffen werden können.
