Abstract

Esta obra compila varios ensayos acerca del Estado de derecho y los continuos llamados que, desde distintos ámbitos, se realizan para evitar lo que algunos consideran la "crisis" de este principio. Los autores se refieren a la problemática desde distintas perspectivas, a saber: desde la teoría del derecho, desde el derecho público y desde el derecho corporativo. Los ensayos han sido escritos, en su mayoría, por estudiantes del programa de Doctorado en Derecho de la Universidad Externado de Colombia, entre quienes se encuentran reconocidos catedráticos, jueces, litigantes y servidores públicos. La obra se complementa con valiosos aportes de juristas como Mark Tushnet, profesor de la Universidad de Harvard [Estados Unidos] y Thomas da Rosa de Bustamante, profesor de la Universidad Federal de Minas Gerais [Brasil], quienes se refieren a los riesgos que para el principio de Estado de derecho representan la hipercomplejidad normativa y la de asuntos políticamente sensibles, respectivamente. Con seguridad, estos ensayos serán de gran interés para la comunidad académica, y darán mucho de qué hablar.
