Вопросы Экспертизы При Принятии Решений В Сфере Государственного Регулирования

Abstract

Предметом исследования является практика взаимодействия государственных структур и экспертного сообщества в рамках регуляторной деятельности государства. Однако привлечение экспертов и экспертных организаций порождает комплекс вопросов, связанных с их квалификацией, степенью достоверности результатов экспертиз, источниками и размерами оплаты их услуг. На примере порядка ста регулирующих функций рассматриваются основания и случаи, когда следует привлекать внешних экспертов к процессу принятия решений в области государственного регулирования. Представлен анализ различных форм оказания услуг экспертов и экспертных организаций, таких как совместная работа государственных структур и подведомственных организаций, частных организаций и экспертов, аккредитованных государством, иных представителей экспертного сообщества. С использованием критериев необходимости и достаточности привлечения экспертов к регуляторной деятельности государства описаны различные сценарии осуществления регуляторной деятельности в зависимости от характеристики исполняемых государственных функций, выявлены ключевые тенденции и проблемы взаимодействия сторон. Оказалось, что диалог между государственными органами и экспертным сообществом осложнен высокими издержками контрактации и значительным риском оппортунистического поведения каждой из сторон. Сделан вывод, что основой для их плодотворного взаимодействия может стать повышение меры ответственности государственных органов и экспертного сообщества за качество принимаемых в рамках регуляторной деятельности государственных решений, а также активное привлечение представителей гражданского общества к разработке государственной регуляторной политики.
