60 Jahre Tarifvertragsgesetz - Eine rechtspolitische Bilanz

Abstract

Der Beitrag gibt einen Überblick über 60 Jahre rechtspolitische Diskussion zum Tarifvertragsgesetz (TVG) und greift "exemplarische Problemfelder" auf. Die Entstehung des TVG war stark konsensorientiert. Gewerkschaften und Arbeitgeberverbände strebten ein "liberales, von staatlichen Einflüssen möglichst freies" Tarifrecht an. Bei näherer Betrachtung werden jedoch Bruchstellen dieses Konsenses sichtbar. Die rechtspolitische und rechtliche Diskussion zum TVG in den folgenden Jahren betraf und betrifft vor allem die Aspekte von tariflichen Sonderleistungen für Gewerkschaftsmitglieder, ferner die Ausweitung des tariflichen Geltungsbereichs (durch AVE, AEntG, Tariftreuegesetze und gesetzlichen Mindestlohn) und schließlich das Verhältnis des Tarifvertrages zu anderen Regelungsebenen (Arbeitsvertrag, Betriebsvereinbarung) und in diesem Zusammenhang Initiativen für gesetzliche Öffnungsklauseln. Die Analyse schließt mit einem Ausblick, der die Bindungsverluste der Verbände, staatliche Hilfen zur Festlegung von Mindestentgelten sowie die europäische Entwicklung thematisiert, die kritisch eingeschätzt wird.
