L?impresa selvicolturale nel sistema del diritto agroambientale internazionale ed europeo, tra sostenibilit? e multifunzionalit?

Abstract

Il nuovo testo unico in materia di foreste e filiere forestali di cui al d.lgs. 3 aprile 2018, n. 34, riapre il dibattito sul ruolo dell?impresa selvicolturale, assegnando a questa il delicato compito di contribuire alla realizzazione di una "gestione forestale sostenibile". Il concetto, tuttavia, non trova una compiuta definizione nel diritto interno ma presuppone un?analisi del diritto europeo ed internazionale. Questo, infatti, fissa obiettivi, principi e criteri cui l?attivit? di selvicoltura si deve uniformare e che segnano i tratti distintivi rispetto alla coltivazione ed all?allevamento. Lo scritto muove descrivendo il contesto concreto su cui interviene la nuova disciplina; successivamente, ne isola le novit? pi? significative; infine le proietta in quell?orizzonte pi? ampio che trascende i confini nazionali.
