Judicial local protection and corporate litigation outcomes: A study based on legal big data

Abstract

Utilizing first-instance judgment documents of Chinese listed companies, this study investigates the existence and influence mechanisms of judicial local protection within corporate civil litigation. Our findings reveal that judicial local protection remains prevalent in China. Further analyses indicate that the characteristics of the involved company, the trial court, and the specific case significantly affect the degree of judicial local protection. This study contributes to a deeper understanding of the issues in judicial practices, offering valuable insights for companies to navigate litigation risks and guidance for countries to enhance the justice of judicial systems.
