Internationaler Investitionsschutz: Die Fakten

Abstract

Die Kritik der geplanten Freihandelsabkommen der EU mit Kanada und den USA wendet sich in besonderem Maße gegen die darin enthaltenen Bestimmungen zum Investorenschutz. Betrachtet man die Daten, so zeigt sich, dass die Erfolgsaussichten bei den Schiedsgerichtsverfahren für Investoren weit geringer sind als die der Staaten, und selbst im Fall eines Sieges erhalten sie nur einen Bruchteil ihrer Forderungen. Die Anzahl der Streitfälle ist über die Zeit hinweg nicht überproportional zu den Auslandsdirektinvestitionen gestiegen. Innerhalb der Gruppe der Staaten, aus denen viele Klagen hervorgehen, sind US-Investoren weit weniger klagefreudig als Investoren aus anderen OECD-Staaten inklusive Deutschland.
