Bail-in als stumpfes Schwert zur Bankenrettung? Sanierung und Abwicklung in der europäischen Bankenunion

Abstract

Der Deutsche Bundestag hat am 24. September 2015 das Abwicklungsmechanismusgesetz zur Umsetzung des Einheitlichen Abwicklungsmechanismus für Banken verabschiedet. Damit soll im Euroraum ein verbessertes rechtliches Instrumentarium bereitstehen, um Banken in einer möglichen Schieflage sanieren oder abwickeln zu können. Nach Ansicht von Sarah Zech, GSK Stockmann + Kollegen, München, und Bernd Rudolph, Ludwig-Maximilians-Universität München, wird die Abwicklungsfähigkeit ein wichtiger Schritt zur Lösung des Too-big-to-fail-Problems von Banken sein.
