Der Schienenverkehr in der besonderen Ausgleichsregelung des EEG: Stand und Perspektiven

Abstract

Im Rahmen der Novellierung des EEG sehen sich Ausmaß und Reichweite der Begünstigungen im Rahmen der sog. Besonderen Ausgleichsregelung (BesAR) des EEG schwerwiegender Kritik ausgesetzt und sind zugleich Gegenstand beihilferechtlicher Überprüfung. Nachfolgend werden die Begünstigungsregelungen für den Schienenbahnsektor im Hinblick auf ihre Übereinstimmung mit dem normierten Regelungsziel des Erhalts intermodaler Wettbewerbsfähigkeit untersucht, Optionen für eine stärkere Fokussierung identifiziert und die Neuregelung im EEG 2014 bewertet. Dabei zeigt sich, dass eine klare Fokussierung von Begünstigungen auf überzeugende Zielstellungen von zentraler Bedeutung ist.
