Die Externalisierung des europäischen Flüchtlingsschutzes: Eine rechtliche, praktische und politische Bewertung aktueller Vorschäge

Abstract

In vielen europäischen Staaten steigt die Zahl der Asylanträge ebenso wie der Zuspruch für rechtspopulistische Parteien weiter an. Initiativen wie der Ruanda-Plan der britischen Regierung und das Albanien-Abkommen der italienischen Regierung können als Reaktion darauf verstanden werden. Sie zielen auf eine Verlagerung von Asylverfahren in Drittstaaten. Damit sollen die Ankunftszahlen markant verringert werden. Vergleichbare Vorschläge in der Vergangenheit gingen nie über das Stadium abstrakter Ideen hinaus. Im Fall Ruandas und Albaniens wird nun allerdings über die konkrete Umsetzung verhandelt. Dem entgegen stehen zahlreiche rechtliche und normative Einwände sowie praktische Hürden. Die vorliegenden Vorschläge zur Auslagerung drohen den internationalen Flüchtlingsschutz in Frage zu stellen und den außen- und entwicklungspolitischen Interessen Deutschlands und der Europäischen Union zu schaden.
