Hochschulpatente zehn Jahre nach Abschaffung des Hochschullehrerprivilegs

Abstract

Die Bundesregierung hat im Jahr 2002 beschlossen, das Hochschullehrerprivileg abzuschaffen. Dieses gestattete es den Hochschulbeschäftigten, Erfindungen, die sie im Rahmen ihres Beschäftigungsverhaltnisses gemacht hatten, als freie Erfindungen selbst zu verwerten bzw. zu patentieren. Seit der Abschaffung des Hochschullehrerprivilegs sind direkte Vereinbarungen über die Verwendung geistigen Eigentums zwischen Hochschulbeschäftigen und Unternehmen ohne Zustimmung der Hochschule nicht mehr möglich, da die Rechte uber die Erfindungen bei den Hochschulen liegen. Die Bundesregierung verfolgte mit der Abschaffung des Hochschullehrerprivilegs folgende Ziele: Stimulierung des Wissens- und Technologietransfers (WTT) zwischen den Hochschulen und der Wirtschaft, Effizienzsteigerung des WTT durch die Bündelung der Verwertungsaktivitaten an einer Stelle innerhalb der Hochschule, Erschliessung zusätzlicher finanzieller Ressourcen fur die Hochschulen durch die Verwertungserlöse, Schaffung verbesserter Verwertungsanreize auf Ebene der Hochschulangehörigen durch Übertragung der Verwertungskosten und -risiken auf die Hochschule. Die vorliegende Studie gibt einen Überblick daruber, ob die Ziele, mit denen die Abschaffung des Hochschullehrerprivilegs vor zehn Jahren begründet wurde, erreicht wurden.
