La solvabilisation des plans d'aide APA comme outil décentralisé d'assurance et de redistribution

Abstract

La loi du 13 août 2004, dans son article 56, reconnaît aux conseils généraux un rôle de "chef de file" de l'action sociale en direction des personnes âgées, mais un cadre légal, fixé au plan national, encadre étroitement leur action, en particulier en matière de solvabilisation de la demande d'aide, via l'allocation personnalisée d'autonomie (APA). S’appuyant sur les enseignements tirés d’enquêtes réalisées auprès de conseils généraux, cet article montre comment le vide juridique concernant la valeur de l'heure d'aide à utiliser dans le calcul de l'APA permet aux conseils généraux de modifier sensiblement les propriétés de cet outil de financement public, à la fois ses propriétés assurantielles face aux risque de prix induit par la tarification individualisée qui prévaut dans le secteur médico- social, et ses propriétés distributives.
