Le concessioni portuali in Italia - Valutazione dello strumento in una prospettiva europea

Abstract

A distanza di quasi 20 anni dalla legge di riforma portuale n. 84/1994 e con una nuova riforma portuale in discussione in Parlamento, lo scopo di questo studio è effettuare una descrizione delle principali caratteristiche delle concessioni portuali in Italia ed in Europa nell’ottica di stabilire le maggiori criticità legate a tale strumento e di individuare i possibili correttivi che la futura riforma portuale dovrebbe tenere in considerazione per migliorare quest’importante aspetto della gestione portuale. Dopo la riforma portuale, infatti, si è sviluppato il sistema della concessione quale strumento di gestione degli spazi portuali, ovvero atti amministrativi con i quali l’Autorità Portuale può dare ad un operatore privato la possibilità di operare in esclusiva una determinata attività in una specifica area portuale. L’importanza di tale strumento risulta palese laddove esso venga interpretato come il mezzo di allocazione della più importante risorsa produttiva portuale e tenuto conto che le caratteristiche delle singole concessioni possono influire sulle potenzialità di sviluppo dei diversi porti. Lo studio sarà sviluppato attraverso confronti tra differenti scali, non solo italiani, al fine di individuare le maggiori particolarità e criticità dello strumento e delineare i possibili miglioramenti che potrebbero riguardare la futura riforma della portualità italiana
