Sobre Maldições e Bênçãos: É Possível Gerir Recursos Naturais de Forma Sustentável? Uma Análise sobre os Royalties e as Compensações Financeiras no Brasil

Abstract

O trabalho procura analisar os riscos e as oportunidades inerentes à gestão e à alocação das rendas provenientes da exploração de recursos naturais no Brasil. Inicialmente, discute-se a questão da maldição dos recursos naturais e, com base na experiência internacional, são apresentados alguns exemplos de como lidar com seus possíveis efeitos perversos. Em seguida, são apresentados os principais aspectos da legislação brasileira referente às rendas de exploração dos recursos hídricos e minerais. Faz-se ainda uma análise da atual distribuição espacial das compensações oriundas do setor petrolífero, na qual fica evidenciada a concentração dos recursos nos níveis estadual e municipal. Por fim, são apresentadas as propostas mais recentes de mudança na legislação brasileira quanto à sistemática de distribuição das compensações financeiras. This paper analyses risks and opportunities related to the management and the allocation of wealth derived from the exploitation of natural resources in Brazil. We first discuss natural resources curse hypothesis and present some examples to deal with its negative effects based on the international experience. Then, we present the main aspects of legislation which legitimatize wealth from the natural resources exploitation in Brazil. We also examine the actual distribution of wealth derived from petroleum exploitation, showing wealth concentration in some states and municipalities. Finally, we present the more recent proposals for changing Brazilian legislation about distribution of wealth derived from natural resources exploitation.
