Du partenariat au mariage : le pari impossible d’un dispositif marital parallèle pour les couples de même sexe en Islande

Abstract

A l’aide d’une quarantaine d’entretiens avec des personnes homo- bisexuelles réalisés en 2005 en Islande, une analyse de la réception du partenariat confirmé, loi conjugale proposée aux couples de même sexe en 1996, révèle l’impossibilité de considérer cette loi comme un équivalent du mariage. Replacée dans son contexte juridique et social, la loi est décortiquée dans ses contours pratiques et symboliques par les personnes enquêtées qui la rejettent et montrent l’insuffisance de ce dispositif marital discriminant, non seulement du point de vue juridique mais également dans ce qu’il dit de leur place dans la société. La loi sera abrogée par l’ouverture du mariage pour tous en 2010.
